1. Purpose

This Acceptable Use Policy (“AUP”) defines acceptable and prohibited uses of services
provided by AussieWave Hosting PTY LTD (“AussieWave”).
This AUP forms part of and is incorporated into our Terms of Service.

2. Lawful Use

You must use our services in compliance with all applicable Australian and international laws,
regulations, and industry standards.
You are solely responsible for the content and activities conducted using your services.

3. Prohibited Activities

You must not use the services to:

• distribute malware, ransomware, spyware, or malicious code;

• engage in hacking, scanning, brute-force attempts, or unauthorised access;

• host or distribute illegal, exploitative, or abusive content;

• infringe intellectual property rights;

• participate in phishing, fraud, or impersonation;

• interfere with or disrupt networks, servers, or other customers.

4. Spam & Messaging

The use of our Services for sending spam, unsolicited bulk messages, or abusive email is strictly
prohibited.

This includes, but is not limited to:

• unsolicited commercial email;
• bulk email without valid recipient consent;
• phishing, impersonation, or deceptive messaging;
• use of purchased, scraped, or harvested mailing lists.

You must comply with the Australian Spam Act 2003 and any applicable international anti-spam laws.

Accounts that generate spam complaints, trigger blacklists, or negatively affect platform or IP
reputation may be suspended immediately without notice while the matter is investigated.
Sending unsolicited bulk messages (spam) is strictly prohibited.
You must comply with applicable anti-spam laws, including the Australian Spam Act 2003.
Accounts involved in spam or reputation abuse may be suspended immediately without notice.

4A. Email Reputation & Shared Infrastructure

Email services operate on shared infrastructure and IP reputation.

Activity that degrades sender reputation, causes blacklisting, or jeopardises service for other
customers is not permitted, regardless of intent.

You are responsible for securing applications, scripts, CMS platforms, and credentials used to
send email. Compromised systems are not an acceptable defense.

We reserve the right to suspend or permanently restrict email functionality to protect platform
integrity.

5. Resource Abuse

You must not consume excessive system resources in a manner that degrades service for others.
This includes sustained CPU usage, excessive disk I/O, fork bombs, or runaway processes.
We may impose limits, suspend processes, or restrict services to maintain platform stability.

6. Security Responsibilities

You are responsible for securing your applications, scripts, credentials, and endpoints.
Compromised accounts that pose a risk may be isolated or suspended without prior notice.

7. Enforcement

We may investigate suspected violations of this AUP.
Enforcement actions may include warnings, service restrictions, suspension, or termination.
We are not obligated to provide advance notice where immediate action is required.

8. Reporting Abuse

Suspected abuse or violations may be reported to
support@aussiewave.au.

9. Changes

We may update this AUP from time to time.
The latest version will be published on our website and applies prospectively.
